| There are currently two lists and we recommend that you sign
up on both of them because the different agencies have different jurisdictions and
enforcement procedures. Please note that Access America does not telemarket
residential customers. 1. Tennessee Do Not Call Telephone Sales
Solicitation Law T.C.A. Section 65-4-401 et seq.
The State of Tennessee (http://www.state.tn.us) has
instituted a Telemarketing Do Not Call List for residential customers in Tennessee as of
July 1, 2000. It is FREE to sign up on the list. The telemarketers who call
residences must obtain (purchase) the list from the State of Tennessee so they don't call
you. There are certain exceptions to the rule. Telemarketers from
not-for-profit companies are still allowed to call residential customers. Also, if
you have done business with a company within the last 12 months telemarketers from that
company are allowed to call you. In addition, telemarketers are allowed to call you
if you have requested that someone call you. For more information you can follow

2. Federal Trade Commission (FTC) and the Federal Communications Commission (FCC)
The Federal Trade Commission (FTC), under its authority for regulating telemarketers at
the federal level under the Telemarketing and Consumer Fraud and Abuse Prevention Act of
1994 and the Telemarketing Sales Rule of 1995 and the Do Not Call Implementation Act of
March 11, 2003, has instituted a Telemarketing Do Not Call List for residential customers
Nationwide starting June 27, 2003. It is FREE to sign up on the list. The list
will go live on October 1, 2003. You will need to sign up on the list every 5 years.
The only information that is kept is your telephone number. Your telephone
number will be removed from the list if it is disconnected. Telemarketers will not
be allowed to call you unless 1) you have a prior established business relationship, 2)
you have given prior written consent, 3) the call is not commercial or does not include
unsolicited advertisements, 4) calls on behalf of or by non-profit, tax-exempt
organizations. Telemarketers must obtain the list before telemarketing residential
customers (consumers). The Federal Communications Commission (FCC) added additional
enforcement rules to the FTC's list. The FTC and the FCC will coordinate enforcement
